一、胡文凯与庆阳市万盛工贸有限公司租赁合同纠纷上诉案

【裁判要旨】

地方性法规、规章关于房屋租赁的管理性规定,不能对抗全国人大及其常委会制定的法律和国务院制定的行政法规中关于合同效力的规定。未取得房产证、规划许可证、不符合消防条件等属于违反管理性法律规范,而非违反效力性法律规范,不必然导致合同无效;只要房屋租赁合同是合同双方的真实意思表示,不违反法律的强制性规定,不损害社会公共利益和第三人合法权益,应为有效合同,合同双方应按合同规定履行义务。

[Judgment Abstract] 

No legal provisions on administration of housing lease in local regulations and rules may counter those on validity of contract in the laws issued by the National People's Congress and its Standing Committee as well as the administrative regulations by the State Council. A failure to obtain the real estate ownership certificate or planning permit, or non-compliance with fire control conditions, among others, is a violation of legal norms on administration instead of those on validity. Thereupon, such failure will not necessarily invalidate a housing lease contract. Provided that a contract is formed based on the true declaration of will by both parties, and neither violates the mandatory provisions of laws, nor harms public interest and lawful rights and interests of any third party, it should be determined as a valid contract, to the extent that both parties thereto should fulfill their respective obligations in accordance with the contract.

二、大连鹏程假日大酒店有限公司诉大连正典表业有限公司房屋租赁合同纠纷案

Dalian Pengcheng Holiday Hotel Co., Ltd. v. Dalian Zhengdian Watch Industry Co., Ltd. (case regarding dispute over a housing lease contract)

【裁判摘要】

因不可抗力导致当事人不能履行合同的,可部分或者全部免除责任。承租人的经营范围包括餐饮、客房两部分,因非典疫情和政府有关部门下发的停止野生动物经营的通知,只对其部分餐饮经营活动造成影响,不足以导致其与出租人之间的租赁合同不能履行。故承租人停止全部经营活动,亦未按合同约定期限支付租金,并非不可抗力原因所致,应依法承担违约责任。

[Judgment Abstract]

A party who fails to perform a contract due to force majeure may be exempt from its liabilities in whole or in part. Since the business scope of the lessee herein covers catering and accommodation, but the notice issued by relevant authorities to crack down on the wild animal business during the SARS epidemic should barely exert an impact on the catering business of the lessee, far from enough to cause its failure to perform the lease contract with the lessor. Therefore, the lessee should, in accordance with the law, assume its liability for breach of contract if it stops its entire business activities and defaults on payment of rents as agreed in the contract, which is not attributed to force majeure.

三、罗爱宁与庆阳市西峰区西街办寨子村桥西村民小组房屋租赁合同纠纷上诉案

Luo Aining v. Qiaoxi Villagers' Group of Zhaizi Village, West Street Office, Xifeng District, Qingyang City (appeal case regarding dispute over a housing lease contract)

【裁判要旨】

未经出租人同意,承租人擅自将房屋转租给他人的,原则上应被认定为无效,但是,若出租人事后对该转租行为予以追认的,则应视为同意转租,即转租行为有效。在此种情况下,当出租人与承租人的房屋租赁合同期限届满时,出租人可以直接要求次承租人履行腾房义务,若次承租人逾期腾房的,还可以要求其支付逾期腾房的占有使用费。

[Judgment Abstract]

Without the consent of the lessor, the lessee's act of subleasing the house to others should be deemed as null and void in principle. Notwithstanding, if the lessor ratifies the sublease afterward, it should be deemed that the lessor consents with the sublease. That is, the sublease act is effective. In this case, when the lease contract between the lessor and the lessee expires, the lessor may directly require the sublessee to fulfill the obligation of vacating the premises. If the sublessee fails to vacate the premises within the prescribed time limit, the lessor may require the sublessee to pay a fee of possession and use arising from delayed vacation.
