Are you protected by labor Law?

More and more expats working in Chinanow.  Usually, these expats thought theyare protected once they sign the labor contract as their Chinese collegesdo.  However, they find they can’t getany compensation as their Chinese colleges does if they are let go by theemployer, even when they sign the same labor contract.  Why?

 

Because the employer didn’t apply for workpermit for the expat employee.  Withoutwork permit, their labor relationship couldn’t be recognized and protected byLabor Contract Law of PRC.  Meaning, oncethe labor contract expire, the Chinese employee could get one monthcompensation for each year he/she work for the employer, while the expatemployee get no cent.

 

Another benefit of work permit is that theexpat employee could join the social security program. It may help once anemployee is accepted by local hospital because of any emergency.
