How could I register my trademark in China

Sophie Mao LegalTips 2020-01-24

Firstly, you have to find an eligible agent. Trademark applications involving foreigners must be handled through officially authorized agents, according to the law.

Secondly, you have to provide the following information to your agent:

1.The trademark in Roman script

2.The trademark in Chinese characters

3. E-copy of the logo

4. Copy of Business License or certificate of incorporation or the equivalent, if your company is the applicant; or copy of passport or ID, if any individual is the applicant.

5. Name and address of the applicant.

Note: any single trademark in China may consist of Roman script, Chinese characters and a logo.   It’s fine only register your trademark in Roman Script, but it’s strongly recommended that you give yourproduct a nice Chinese name if you are going to sell your product in China, sooner or later.   The truth is, if you do not choose a name inChinese and register it, the Chinese consumer will almost certainly choose a Chinese name for you and you may find you do not like that Chinese name, and more worse, it's already registered by your competitor!
