Can My Employer/Agent blacklist Me?

The first story is shared by Lady A in Guangzhou, she is expecting her Chinese Green Card (“GC”) now. “I submitted paperwork October 2021, in November had the interview. After that the waiting time is around 1 year at the moment.” She told us: “It’s very rare they don’t give it after waiting so long, so most likely will get it this autumn.”

“I paid the application fee at the interview, it means application officially accepted. From Guangzhou it goes to Guangdong government, then to Beijing. Final approval and card is done in Beijing. Once the card is done, it can still take months before they call you.” But she is confident about she will get the GC eventually: “In general if there was any problems, they would have called already.”

However, she can’t help to complain: “The hardest thing is, some of the clerks doesn’t know what is needed. Because of him I had to go to the immigration many times. Each time he thought of something new.”

The following is her story(we use Q & A style to make the whole story more clear):

Q1. Why do you want to apply for a green card?
A: Because I have lived in China for 12 years and want to stay. Green Card gives more freedom on working, freelancing, easiness to traveling.

2. Do you have any concern before doing so?
A: Heard from many people paperwork can take long time and waiting time is long.

3. From which source you know about green card?
A: Many.

4. Did you do it all by yourself or anyone else helped you?
A: By myself, no need for agent. For non criminal record from my country, a family member helped. If that’s not possible, you can use agent for this.

5. What’s the most difficult part in this procedure?
A: Non criminal record from your country if you are stuck inside China, you need family or agent to help. The information you get from the immigration is also different each time you ask, it’s hard to get a list of everything needed with one visit. You need 100-200k of cash and freeze it in a bank for 6-12 months.

6. What impress you the most?
A: Nothing.

7. Do you mind to let me know the cost involved?
A: Costs include: non criminal record from your country, notarizing and translating documents, if you don’t need an agent, these will be something around 1000-1500rmb. Then the green card application fee to the immigration.

8. How long did it take in total?
A: About 3 months to prepare documents. Around 1 year to get the card.

9. Any difference you can feel after you get the green card?
10. Have you ever renewed your green card?  What’s the procedure and documents required?
A: I’m waiting for my card.

11. Any tips you want to share with other applicants?
A: We have a group for applying spousal green card, join it!

Second story is shared by Mr. B in Beijing, just like Lady A, he got his GC through family reunion route, he commented that the whole procedure is fairly straightforward. The story is as follows:

Q1. Why do you want to apply for a green card?
A: For convenience.

2. Do you have any concern before doing so?
A: No.

3. From which source you know about green card?
A: Government website.

4. Did you do it all by yourself or anyone else helped you?
5. Myself.

5. What’s the most difficult part in this procedure?
A: making sure all the documents are in line with requirements; dealing with staff who don't know the procedure.

6. What impress you the most?
A:The speed with which it was processed.

7. Do you mind to let me know the cost involved?
A: Can't even remember, not expensive. However, you need to freeze a substantial amount prior to application. You also need to prove that you have a stable abode in China.

8. How long did it take in total?
A: 8 months.

9. Any difference you can feel after you get the green card?
A: More flexibility when making career decisions, advantageous when dealing with HR.

10. Have you ever renewed your green card?  What’s the procedure and documents required?
A: Not yet.

11. Any tips you want to share with other applicants?
A: Confirm every document needed is in line with requirements at the central bureau in your city person.

Just like the one we shared before, all the three people do the application by themselves, it means the application is not so difficult.  As long as you do enough research, collect right information from right source, find the right route for you.
If you don’t want to spend the time to do research, you can hire someone to do it for you. But firstly, you need to understand if you are eligible or not, again, you can spend some time to do self-assessment or hire someone to do it for you.
Hope the stories we are sharing today is helpful.
