China to handle cross border disputes with foreign legal cases

The Supreme People's Court of China has announced its intention to issue a judicial interpretation aimed at streamlining the application of foreign laws in resolving international disputes. This move comes as a result of the increasing cooperation between China and countries participating in the Belt and Road Initiative (BRI), leading to a surge in cross-border business transactions and related commercial disputes.



Gao Xiaoli, Chief Judge of the Fourth Civil Division of the Supreme People's Court, emphasized the significance of accurately identifying foreign laws in handling international commercial cases. She highlighted that the formulation of this judicial interpretation reflects respect for litigants both domestically and internationally, ultimately providing safeguards for international transactions.


Drafting this interpretation has been a challenging task due to the varying legal systems among participating countries of the BRICS initiative. Gao revealed that a considerable amount of time and effort has been devoted to researching and determining the methods and procedures for applying foreign laws.
